The superannuation guarantee (SG) legislation requires you to make contributions for most employees to a complying super fund.
You are required to contribute an amount equal to 9% of an employee's earnings base, based on ordinary time earnings (OTE).
The Australian Tax Office (ATO) may apply financial penalties if SG amounts are not paid to a super fund by the 28th day after the end of the relevant SG quarter (i.e. 28 January, 28 April, 28 July and 28 October).
Generally, you need to pay SG contributions for employees over 18 and less than 70 years of age when they earn $450 or more in a calendar month.
Under SG, you don't have to make SG contributions for employees who are:
Other exemptions do apply. You may also be obliged to contribute under conditions that are different to SG according to a workplace agreement or industrial award.
TIP: The Australian Tax Office has more information about your SG obligations for employees and exemptions.
You need to calculate SG contributions quarterly and pay them by the 28th day after the end of the quarter.
| SG Quarter | ATO Payment Deadline |
| 1 October - 31 December | 28 January |
| 1 January - 31 March | 28 April |
| 1 April - 30 June | 28 July |
| 1 July - 30 September | 28 October |
In some instances, you may have additional obligations arising out of an Industrial Award or industrial instrument requiring contributions to be remitted more frequently.

Salary sacrifice contributions arise from an agreement between you and an employee to exchange a nominated amount of pre-tax salary for additional super contributions of the same amount.
Employee's after-tax contributions are paid from after-tax income. The employee can arrange the payments themselves, or they may ask you to deduct and then contribute these amounts as part of the payroll process.
Salary sacrifice (classed as employer-additional contributions) and employee after-tax contributions need to be clearly identified in your contributions data.
